Local Law 126 of 2021 requires periodic inspections of parking structures in New York City — and the compliance clock is running. If your building has a parking garage or lot, here is what you need to know.

What Is Local Law 126?

Local Law 126 was enacted in 2021 following the collapse of a parking garage in Manhattan. It requires all parking structures in NYC — garages, lots, and parking decks — to be inspected by a licensed engineer every 6 years. The first cycle began January 1, 2024.

Who Does Local Law 126 Apply To?

Local Law 126 applies to any parking structure — including garages, rooftop parking, and outdoor parking lots — that are part of a building subject to NYC building code. Both residential and commercial properties with parking structures must comply.

What Happens During an Inspection?

A licensed professional engineer inspects the structural elements of the parking structure — concrete slabs, beams, columns, connections, and drainage systems. The engineer classifies the structure as Safe, Unsafe, or Safe with Repairs and Maintenance Program (SWARMP) — similar to the Local Law 11 facade inspection classifications.

What Repairs Are Typically Required?

Parking structures are subject to significant wear from vehicle loads, deicing salts, and freeze-thaw cycles. Common repairs include concrete spalling repair, rebar corrosion treatment, joint sealing, drainage repair, and structural crack repair. Local Law 11 applies to building facades. Local Law 126 applies to parking structures. They are separate inspection and compliance programs with different requirements and timelines. A building may need to comply with both if it has both a multi-story facade and a parking structure.
